Terms and Conditions - MyMedVault (MMV)

1. Introduction

Welcome to MyMedVault ("MMV", "we", "our", or "us"), a wellness platform that allows individuals ("users", "you") to securely store, manage, and share personal health and medical information, and access wellness services through an integrated marketplace. These Terms and Conditions govern your access to and use of our services, including the mobile application, website, and all features and functionalities.

By creating an account, using our services, or accessing the platform in any way, you agree to be bound by these Terms.

2. Definitions

  • User: Any individual who registers an account on MMV.
  • Patient: A user who uploads or manages personal health data.
  • Carer: A user who manages the account of a dependent (e.g. child, elderly parent) with legal or granted authority.
  • Care Provider: A licensed healthcare professional authorised by the patient/carer to view health data.
  • Dependant: A minor or individual under care whose account is managed by a guardian or carer.
  • Marketplace Partner: A third-party company offering services or products via MMV.

3. Platform Purpose

MMV is a wellness data storage and sharing platform. It does not provide medical advice or telemedicine services. MMV includes a marketplace for wellness and medical-related services/products. All marketplace interactions are between the user and the third-party provider.

4. Eligibility

  • You must be at least 18 years old to create a standard account.
  • Accounts for dependants under 18 must be created and controlled by a parent or guardian, who retains full access and control until the dependent reaches 18.

5. User Responsibilities

  • Ensure all data you upload is accurate and lawful.
  • Do not misuse, share without permission, or upload harmful or misleading content.
  • Respect consent frameworks when sharing or viewing another person's data.
  • You are responsible for any activity conducted under your account.
  • You are responsible for keeping your login credentials secure and must not share your account access with others.

6. Consent and Data Sharing

MMV offers flexible sharing and consent features:

  • Long-term linking with carers, spouses, or dependents for continual access.
  • Short-term sharing for consults, allowing temporary access to care providers.
  • Consent is always required before data is shared with another user or care provider.
  • Consent can be revoked at any time via the app.

7. Data Storage and Privacy

  • Your data is stored securely in Singapore and managed in accordance with applicable laws.
  • See our Privacy Policy for more on data use, storage, rights, and anonymisation.
  • MMV uses industry-standard encryption and follows regulations such as PDPA, GDPR, and HIPAA where applicable.
  • Upon deletion, personal data will be erased where legally permitted, but anonymised data may be retained.
  • By uploading content, you grant MMV a non-exclusive, worldwide, revocable license to store and process your content in accordance with the Privacy Policy.

8. Marketplace and Third-Party Services

  • MMV acts as a marketplace only. Any purchase or subscription is a direct agreement between you and the Marketplace Partner.
  • MMV does not endorse, guarantee, or assume liability for any third-party service.
  • Users must exercise due diligence before making any purchase.
  • Marketplace Partner terms and conditions apply to their services.

9. AI-Generated Content and Health Insights

  • MMV provides health insights powered by AI and curated data. These are not medical advice.
  • Always consult a qualified care provider for diagnosis or treatment.
  • MMV is not liable for any decisions made solely based on AI insights.

10. Account Termination and Deletion

  • You may delete your account at any time.
  • Upon account deletion:
    • Personal data will be erased unless required for compliance or retained in anonymised form.
    • Subscription refunds will not be provided unless required by law.
  • We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.

11. Intellectual Property

  • All MMV content, software, and branding are protected intellectual property.
  • Users may not copy, modify, or redistribute MMV's proprietary materials without written consent.

12. Service Availability and Modifications

  • We may suspend or modify the platform at any time for maintenance, upgrades, or legal compliance.
  • We are not liable for service disruptions beyond our control (e.g. server outages, cyberattacks).

13. Limitation of Liability

MMV is not liable for:

  • Actions taken by users or care providers based on shared information.
  • Marketplace purchases or third-party service failures.
  • Any indirect or consequential damages resulting from the use of the platform.

Our total liability is limited to the amount paid by the user (if any) in the past 12 months.

14. Dispute Resolution

  • If you have concerns, please contact our Customer Support first.
  • If unresolved within 60 days, disputes will be referred to arbitration under the Singapore International Arbitration Centre (SIAC).
  • These Terms are governed by the laws of Singapore.

15. Changes to Terms

We may revise these Terms periodically. Users will be notified via the app or email. Continued use after such notice constitutes acceptance of the changes.
